Welcome to BidOn! These Terms and Conditions ("Terms") govern your access to and use of our online marketplace platform (“BidOn,” "we," "our," or "us"). By registering, accessing, or using BidOn, you agree to these Terms.
1.1 Platform Nature
BidOn is an online platform enabling users located in Germany to post advertisements, buy, sell, or auction items. BidOn itself does not become a party to any contract between users.
1.2 Applicability
These Terms apply to anyone who accesses or uses the platform, including unregistered visitors, registered buyers, and registered sellers.

3.1 Compliance with Law
Users must comply with applicable German law and EU regulations. You agree not to engage in illegal, fraudulent, or harmful activities through the platform.
3.2 Prohibited Content
You will not post listings or content that is unlawful, offensive, obscene, defamatory, misleading, or infringing on third-party rights.
3.3 Fraud Prevention
Fraudulent activities, including misrepresenting the nature or condition of goods, are strictly prohibited. Violation may result in immediate suspension or termination of your account.

You are solely responsible for ensuring that your listings comply with all applicable laws and regulations. BidOn reserves the right to remove listings or suspend accounts involved in prohibited activities without prior notice.
5.1 Accuracy of Listings
All listings must be truthful, accurate, and not misleading in any way. You are responsible for updating or removing listings that become inaccurate or outdated.
5.2 Auction Mechanics
The listing user sets auction duration, pricing, and conditions. All bids placed are legally binding offers to purchase the listed item under the terms specified by the seller.
5.3 Completion of Auction
Once the auction ends, the highest bidder (meeting any specified reserve price or conditions) is obligated to complete the purchase.
6.1 Direct Transactions
BidOn does not handle payments directly. Payment details, methods, and transactions are decided by and conducted between buyers and sellers.
6.2 Secure Payment Methods
We strongly recommend using secure, traceable payment methods (e.g., PayPal, bank transfer). Users should exercise caution and conduct due diligence before completing transactions.
6.3 Transaction Responsibility
BidOn is not liable for any failed or fraudulent transactions. All financial disputes must be resolved between the buyer and seller.
6.4 No Guarantee of Payment
BidOn does not guarantee that any buyer will complete a transaction or pay for an item. Sellers assume the risk of non-payment.
6.5 Buyer’s Obligation to Pay
By placing a bid or agreeing to purchase an item, you enter into a legally binding agreement to complete the transaction. Failure to remit payment may result in account suspension or termination.
7.1 No Warranties
BidOn does not guarantee the accuracy, quality, safety, or legality of items listed. All content is provided “as is.”
7.2 Limitation of Liability
Users interact and transact at their own risk. To the fullest extent permitted by law, BidOn is not liable for any damages arising from disputes or transactions between users.
8.1 User-to-User Disputes
Users are expected to resolve disputes directly and amicably.
8.2 Optional Mediation
BidOn may mediate disputes at its discretion but is not obligated to do so.
9.1 Suspension or Termination
We reserve the right to suspend or terminate accounts found to be in violation of these Terms or applicable laws.
9.2 Effect of Termination
If your account is terminated, you are no longer authorized to use the platform.

Your use of BidOn is governed by our Privacy Policy, which complies with GDPR requirements.
10.2 Data Collection and Storage
We collect and process personal data in accordance with our Privacy Policy and applicable laws in Germany and the EU. User data is stored securely using cloud infrastructure provided by Firebase (Google), with data centers located in the EU where possible. We do not sell user data. Access is restricted to authorized personnel only, and all reasonable measures are taken to ensure data security.
11.1 User Content
You retain ownership of your content. By posting, you grant BidOn a license to use and display your content within the platform.
11.2 Platform Content
All design, text, and graphics are owned by BidOn or its licensors. You may not copy, distribute, or exploit any part without consent.
12.1 Right to Amend
BidOn may modify these Terms at any time. Users will be notified of changes.
12.2 Acceptance of Changes
Continued use of the platform after changes indicates acceptance.
13.1 Governing Law
These Terms are governed by the laws of the Federal Republic of Germany.
13.2 Jurisdiction
All disputes fall under the jurisdiction of Berlin, Germany.
